1. Introduction
These terms and conditions govern your use of the TownPlanning.app website and the planning consultancy services we provide. By using our website or engaging our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our website or services.
2. Services
TownPlanning.app provides town planning consultancy services including pre-application advice, application guidance, application submission and appeal statement preparation. Our services are advisory in nature. While we endeavour to provide accurate and helpful advice, we cannot guarantee the outcome of any planning application or appeal.
All advice is provided based on the information available to us at the time and our interpretation of relevant planning policies and legislation. Planning decisions are made by the relevant local planning authority or the Planning Inspectorate and are outside our control.
3. Fees and Payment
Our fees will be agreed in writing before any work commences. Unless otherwise stated, all fees are quoted exclusive of VAT. Payment terms are 14 days from the date of invoice unless otherwise agreed. We reserve the right to charge interest on overdue payments at a rate of 4% above the Bank of England base rate.
4. Client Responsibilities
You are responsible for providing accurate and complete information about your property, project and circumstances. Any advice we provide is based on the information you supply. We are not responsible for any loss or delay arising from inaccurate or incomplete information.
5. Intellectual Property
All content on this website, including text, graphics, logos and images, is the property of TownPlanning.app and is protected by copyright. You may not reproduce, distribute or use any content without our prior written permission.
Documents and reports prepared by us in the course of providing our services are provided for your use only and may not be shared with third parties without our consent, except as required for the planning application process.
6. Limitation of Liability
To the fullest extent permitted by law, TownPlanning.app shall not be liable for any indirect, incidental or consequential loss or damage arising from the use of our services or this website. Our total liability for any claim shall not exceed the fees paid to us for the specific service giving rise to the claim.
7. Cancellation
Either party may terminate the engagement by giving 7 days' written notice. In the event of cancellation, you will be liable for fees for work already completed up to the date of cancellation, plus any third-party costs incurred on your behalf.
8. Confidentiality
We treat all client information as confidential and will not disclose it to third parties without your consent, except where required by law or where disclosure is necessary for the provision of our services (for example, submitting information to a local planning authority).
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to These Terms
We reserve the right to update these terms and conditions at any time. Changes will be posted on this page with an updated revision date. Your continued use of our website or services following any changes constitutes acceptance of the revised terms.
